FLORIDA VOTERS OVERWHELMINGLY SUPPORT PLACING COMMON-SENSE LIMITS ON LAWSUIT PAYOUTS

Tallahassee, Fla. – The Associated Industries of Florida (AIF) Center for Political Strategy today announced new polling results showing overwhelming bipartisan support for placing common-sense limits on the amount of money personal injury trial lawyers can claim to no more than 20% of the money awarded to a plaintiff so plaintiffs can keep more of the damages won and there is less of an incentive for lawyers to file frivolous lawsuits.

Key findings include:

  • Strong Statewide Support:  An overwhelming 83% of Florida voters support reining in out-of-control lawsuit payouts so working Floridians can keep more of the damages won in personal injury lawsuits, including a strong majority (59%) who say they “strongly approve” of the measure.
  • Overwhelming Bipartisan Support: Support for the proposal garners strong support across party lines, most notably amongst Republicans – 86% of Republicans, 79% of Democrats, and 82% of Independents approve of the proposal.
  • Demographic Support: Placing common-sense limitations on lawsuit payouts has broad majority support across all races and ethnicities – 85% of white voters, 79% of Black voters, and 79% of Hispanic voters support the proposal.
  • Regional Strength: The proposal captures 70%+ approval across all media markets in Florida, including 93% in Ft. Myers, 87% in Orlando, 87% in Tampa, 84% in Jacksonville, 80% in the Panhandle, 78% in Miami, and 74% in West Palm Beach.
  • Support by Age: The measure earns strong majority approval across all age brackets including 87% of seniors and 72% of voters under 30.
  • Trump/Harris Support: Strong majorities also exist amongst Trump and Harris voters - 87% of Trump voters and 80% of Harris voters approve of the measure.

“For too long, a handful of Florida trial lawyers have gamed the system at the expense of hardworking Floridians and small businesses, raking in colossal payouts while their clients keep a small fraction of the damages won. Florida voters overwhelmingly support placing common-sense limitations on the payouts received by personal injury trial lawyers so plaintiffs can keep more of the damages won, which will reduce the incentive for lawyers to file frivolous lawsuits - protecting small businesses from unpredictable legal costs and reducing the burden on consumers who ultimately foot the bill for inflated legal costs,” said AIF Vice President of Political Operations Jeremy Sheftel.

METHODOLOGY: The AIF Center for Political Strategy poll consisted of 800 likely 2026 general election voters in Florida and was conducted August 25-27, 2025, by McLaughlin & Associates. Interviews were weighted by geography, gender, age, party registration, ethnicity, education, and collected via landlines, cell phones, and SMS/text-to-web. The margin of error is +/- 3.5% at a 95% confidence interval. Percentages may not equal 100% due to rounding.
